2020 marks an exciting year in Virginia’s hemp industry. The state recently submitted its plans for a hemp program to the USDA in February of this year. Now, a second draft is being composed which will hopefully serve as the finalized plan.

Growing High CBD Hemp Seed in Virginia: Requirements
Right now, it is legal to grow industrial hemp in Virginia. This includes high CBD hemp seed and clones. Virginia is in the process of finalizing its hemp program plans and submitting them for approval to the USDA. Until then, Virginia plans to treat the 2020 growing season the same way that it treated the 2019 season. This means that farmers growing hemp this year are required to apply for growing registration and submit a planting report. Farmers must also submit to random testing conducted by the department.
However, once the Industrial Hemp Program is officially approved and set into motion, the new guidelines will replace the existing ones. These guidelines outline the requirements for dealers, processors, and growers involved in the hemp and CBD industries. Additionally, they also explain THC testing, planting reports, annual inspections, plant destruction, and commercial sales.
Applying for a License to Grow CBD Seed in Virginia
Under the Virginia Regulatory Hemp Plan (which is currently under review), individuals wishing to grow CBD seed must apply and register with the department. When you complete this application, you will be asked to provide information about yourself and your operations including:
- Name, address, and contact information
- Business entity information
- Criminal history report
- Information regarding the production site
- Information regarding the storage site
In addition, applications must consent to a number of stipulations required by the Virginia Department of Agriculture and Consumer Services. This includes agreeing to file a planting report, agreeing that crops will be destroyed if found to contain illegal levels of THC, agreeing to register with the Farm Service Agency, and other conditions.
