Pennsylvania’s Industrial Hemp Program & Rules for Growing CBD Seed

In 2017, Pennsylvania legalized the production of industrial hemp for research purposes. The state approved a handful of permits and farmers were able to begin growing CBD hemp seed within Pennsylvania state borders. Once the 2018 Farm Bill was passed, more permits were issued, and growers could begin cultivating hemp for reasons beyond research purposes.

Today, Pennsylvania’s hemp industry continues to thrive. Now is an opportune moment for farmers to invest in hemp and make their way into rapidly growing industry. But in order to do so, you must maintain compliance with the guidelines established by Pennsylvania’s Industrial Hemp Program.

Pennsylvania Industrial Hemp Program: What You Need to Know

Pennsylvania has been fine-tuning their industrial hemp program for years. Each year, the Department makes slight adjustments in effort to improve the program and make processes more efficient for farmers. In early 2020, additional changes were enacted. Here are some important highlights:

• Both processors and growers of industrial hemp seed and plants in Pennsylvania are required to have a permit.
• Security is a major concern for hemp licensing in Pennsylvania. After applying for a permit, you have sixty days to obtain an FBI background check.
• You must list the varieties of hemp you intend to grow on your application. (This means you may want to order your CBD seed early in the year, before applying.)
• There are specific guidelines you must adhere to in terms of the location of your operations. Hemp cannot be grown within 1000 feet of a grade school or recreational area. You must also keep your plants 200 feet away from residential buildings.
• You must have your plants tested at least 15 days before harvesting. Testing needs to be conducted by a certified sampler. If you plant multiple varieties, each type must be tested.
• If you don’t own the land on which you’re planting hemp, you must supply a copy of your lease. This document must be signed by yourself and the official property owner.
