Montana Initiates New Hemp Program & Rules for Growing CBD Seed

The Montana Department of Agriculture requires that all individuals who wish to participate in hemp cultivation in Montana must obtain a state license. This means that if you want to grow CBD hemp seeds, clones, or seedlings in Montana, you must first submit an application to the Department.
In November of 2020, Montana will begin implementing their newly USDA approved Hemp Plan. Until then, the state has decided to continue functioning under their previously established Pilot Program and the 2014 Farm Bill. Under the current plan, the state issues licensing in two stages. This includes the initial Planting stage and the Production stage. You need a license for each stage. Here’s how to apply.
Steps for Applying for Hemp Planting and Production Licenses in Montana
Interested in getting involved in Montana’s hemp industry? Follow these steps to apply for Hemp Planting and Hemp Production licenses:
- Obtain CBD seeds or clones that you can legally grow in Montana. The Montana Department of Agriculture separates hemp seed varieties into four different categories.
- Complete an application. Provide your personal information, business information, and information about key participants. On the application, inform the Department of the varieties of hemp you intend to plant and where you sourced them.
- Pay the $850 application fee.
- Sign the Attestation Statement and Risk Acknowledgement Statement.
- Complete a background check.
- Mail your application to the Montana Department of Agriculture.
- Once you receive your Planting license, you can begin planting your hemp seeds or clones.
- Apply for a Production license. In order to obtain this license, you must provide information about the varieties of hemp you’ve planted, the location and quantity of your growing area, and the date that you expect to be able to harvest your plants.
Additional Requirements
In addition to obtaining a Planting License and a Production License, growers must also submit a Hemp Planting Report. If you plant more than one Category C variety of hemp, you will be required to pay additional fees. This cost starts at $250. If you want to sell live plants, you must meet additional requirements.
