If you are planning to grow a CBD crop in California, here is some much-needed information. Whether you have questions about the process or want to get going with your applications, please read the information on these websites very closely. It’s important to stay abreast of changing rules and regulations.
California has not yet put their permanent hemp/CBD farming policy into place, and there are current bans against cultivating CBD in certain counties. The CDFA has not submitted a proposed state regulatory plan to the USDA but is still in the process of preparing one. Unlike most US states, instead of receiving a license to grow industrial hemp from the state, you’ll need to apply to the specific county you live in.
California Department of Food and Agriculture (CDFA): This will be your primary resource for the state’s hemp cultivation regulations. All forms, registration fees, regulation updates, and more can be found on the Industrial Hemp Program’s website. The FAQ section includes up-to-date information on both local and federal regulations. This should be your starting point to gather the necessary forms and information needed to get started. - California Hemp Grower Application Packet: This comprehensive document includes state regulations and the program overview. Farmers interested in growing hemp commercially will need to read through this packet, complete the application, complete a background check, and submit the form through their respective county for approval. The county commissioner will provide licensing after your application is approved. This packet also contains important information including approved CBD seed cultivars, THC testing, sampling procedures, and more.
- California County Agricultural Departments: While most counties have legalized hemp farming, these regulations are always evolving. This resource offers all of the agricultural department website links associated with each county. We recommend finding the county you plan on cultivating hemp in and researching county regulations and restrictions before submitting your application. Farmers in California will have to stay compliant with the county, state, and federal regulations.
- FBI Background Checks: Farmers will need to undergo a background check from the FBI in addition to completing their application and submitting the corresponding $900 fee. State regulations prohibit individuals with convicted felonies related to a controlled substance from registration for a period of 10 years following the conviction date. Hemp growers are also prohibited from committing three negligent violations within a five-year period from registration. Negligent violations are given to farmers whose THC threshold is above the allowed legal 0.3%.
- Industrial Hemp Application Business and Contact Amendment: If you need to make any changes to your original application in regards to registered contact, business, or key participant information, this is the form you’ll need. Make sure to always provide regular updates in order to keep your farm compliant.
- Industrial Hemp Registered Site Amendment: If you need to make any changes to your original application in regards to the registered site, cultivator, or variety development plan, you’ll need to complete and submit this form. You’ll need to keep up with all of this paperwork in order to stay compliant with both local and state regulations.
- California Industrial Hemp Application for Testing Laboratory Approval: This important document contains guidelines on hemp sampling for the required THC testing. Unlike other states, there is no list of state-provided labs. Farmers must read through this information, find an accredited lab with International Organization for Standardization (ISO) or International Electrotechnical Commission (IEC) certification, and submit this form for testing approval. The CDFA must approve this lab before you are able to submit pre-harvest and post-harvest THC testing. Forms can be submitted via email.
- California Hemp Pre-Harvest Report: The pre-harvest report requires THC testing of your crops and must be sent to the county agricultural commissioner at least 30 days before your scheduled harvest date. Farmers must notify the county agricultural commissioner of any changes at least five days before their scheduled sampling date.
- California Hemp Harvest Report: Farmers must complete their harvest report within 72 hours from the completion of their harvest. The harvest report must be submitted to the respective county agricultural commissioner with a laboratory test report with a total THC of less than three-tenths of one percent. The form includes report instructions and the steps you’ll need to take.
- California Hemp Destruction Plan: If your harvest surpasses the legal THC threshold, your crops must be destroyed. However, you must complete this form with your destruction plan and submit it to your local county agricultural commissioner for approval. Destruction must begin within 48 hours of receiving a lab report with THC content over one percent and must also be completed within seven days.

California’s Hemp Biomass Transportation Regulations
The CDFA requires farmers to include an original copy of their hemp biomass lab test report with each person that’s transporting. This policy extends to all raw hemp materials including hemp fiber, cake, oil, seed, or any component of the seed. It is important to note that as of 12/30/20, the California Department of Motor Vehicles (DMV) and the California Highway Patrol do not have additional requirements that apply to transporting hemp. This can change at any time so we recommend that you check with these departments in addition to any applicable city, county, or state officials. SEPTEMBER 3, 2020: Bill to Legalize CBD in California Fizzles in State Senate
The bill AB 2028 was introduced in order to create a regulatory framework for hemp-derived CBD products, containing regulatory information for testing and labeling requirements. While hemp-derived CBD is federally legal, these products are being illegally sold in California since the state has aligned its position with the FDA. Unfortunately, the bill was not passed, leaving industry stakeholders and consumers hopeful for another push.
AUGUST 17, 2020: The Return of Hemp Research
The 2018 Farm Bill has made hemp research more available, allowing researchers to learn more about the 25,000 different applications the plant has to offer. Researchers across the nation’s different universities have begun these much-needed hemp studies. Regions like Southern California have the competitive advantage of producing higher levels of CBD.
FEBRUARY 12, 2020: California bans drug felons in hemp production to comply with federal rules
California has instituted a 10-year ban for individuals with felonies related to controlled substances in order to stay compliant with a federal mandate. The emergency ruling was issued in order to receive permission from the USDA for regulating the state’s hemp industry. Individuals with convicted drug felonies will have to wait at least 10 years from their conviction date before applying for a growing or processing license.

NOVEMBER 3, 2019: Millions of cannabis plants in California with ‘black market’ value of $1B seized and destroyed

This means that the THC content of the plants was much higher than the 0.3% allowed for industrial hemp.
